Parties to the Contract and Definitions

A & L EVENTS LTD. Our Registered Company Number is 15199722, and our Registered Office address is 1 Meadow Way, Fifield Road, Maidenhead, SL6 2PE.

For the purposes of this contract, we will be referred to as “A&L HIRE,” “we,” “our,” or “us.”
-
You are the individual or corporate entity hiring a trailer from us, and for this contract, you will be referred to as “you,” “your,” or “Hirer.”
-
These terms apply to the hiring of any trailer and all services we provide to you. We reserve the right to change these terms without prior notice for any future hire.

Any reference to the trailer encompasses all accessories and additional products/equipment provided as part of the trailer hire.

Availability and Price of the Refrigerated Trailer Hire Services
-
All trailers are subject to availability at the time of your order. If the trailer you ordered becomes unavailable between the receipt of your order and the start of your hire, we will notify you as soon as possible and arrange for an immediate refund of all sums paid for the hire period.

We accept no responsibility or liability for any compensation, costs, or expenses incurred if your contract with us is affected or prevented by events beyond our reasonable control. This includes, but is not limited to, any delays or restrictions related to your hire. However, if your booking must be cancelled as a result, we will provide a full refund, and we will have no further liability in this regard.

We will make every effort to ensure that prices and descriptions in our quotations or on our website are accurate at the time you place your order.

Payment and Cancellation

To confirm a booking, an initial, non-refundable deposit of 50% is required. This deposit will be forfeited in the event of cancellation or failure to provide full payment or required documents as per these terms.

Please be aware that the trailer will not be available to you until we have received cleared funds for all sums due for the hire services.

Payment must be made by BACS or cash only.

If you fail to make any fee payment as per these terms, you will be considered to have requested the termination of the contract, and we may release the trailer reserved for you to another customer without liability to you.

Delivery and Collection of the Trailer
-
Trailers are delivered and collected during designated “AM” (between 08:00 and 12:30) or “PM” (between 12:30 and 18:00) time slots. You will need to specify your preferred time slot on the Booking Summary & Contract of Hire. We will strive to deliver and collect within the requested time slot, but we reserve the right to reallocate an alternative delivery and/or collection time if necessary. We will make every effort to notify you of any changes to the delivery/collection time. We accept no liability for delays caused by factors outside our reasonable control.

We will prepare a Trailer Hire Condition Form detailing the trailer's condition and any damage noted before your hire period starts. You will need to sign the Condition Form upon delivery to acknowledge your acceptance of the trailer's condition. Please read the Condition Form carefully before signing.

We will do our best to ensure the trailer is available for delivery on the requested date and time slot, but we are not liable for any delays due to factors beyond our control.

Note that, regardless of your payment of all sums owed to us for the proposed hire, the trailer will not be made available until we are satisfied with your identification documents. The trailer will not be released until all required documents are submitted according to these terms.

The trailer must be placed on a flat and level hard-standing base provided by the Hirer. If the trailer is situated in a building or marquee, adequate ventilation must be ensured to maintain an ambient temperature of no more than 22 degrees Celsius.

The mains power socket must not be more than 15 meters from the unit using a 13amp cable or 18 meters from the unit using a 16amp cable. Failure to comply with this condition may result in damage to the unit, which will be charged to the Hirer.

The Hirer must ensure adequate ventilation around the contents to maintain an even temperature. The stored contents must be food-safe and free from contamination. It is the Hirer’s responsibility to adhere to all temperature criteria.

Rental Period Responsibility
-
The hire period will commence on the date and time specified in the Rental Agreement and will conclude on the date and time indicated in the Rental Agreement.

The hire period cannot be extended without our prior written consent. Unauthorized extensions to the rental period will incur additional charges.

During the hire contract, you shall:
-
take all necessary precautions to secure the trailer from theft or damage;
-
indemnify us against all fines, penalties, and liabilities incurred due to your hire and/or use of the trailer or arising from non-compliance with transport, traffic, or other laws and regulations, including any associated costs;
-
accept liability for damage to or loss of the trailer, including all accessories and additional equipment hired to you under a Rental Agreement;
-
acknowledge that all trailers are immobilized with a wheel clamp and hitch-lock upon delivery. Unauthorized removal leading to loss or damage will be considered a deliberate act, and all associated costs will be charged to you in full;
-
accept that any goods or produce placed in or on the trailer remain your responsibility, and Cool Running Trailer Hire Ltd accepts no liability for any loss or damage caused to or by said goods or produce;
-
acknowledge that your use of the trailer(s) is entirely at your own risk during the hire period;
-
refrain from selling, assigning, mortgaging, lending, letting on hire, or otherwise disposing of or parting with possession of the trailer or any part thereof;
-
not remove or interfere with any identification marks, livery, or plates affixed to the trailer;
-
take necessary steps at your own expense to regain possession and control of the trailer if you lose it.

Under no circumstances is the Hirer permitted to:
-
alter or modify the unit and its associated equipment;
-
remove the refrigeration and its associated equipment;
-
deny access to Cool Running Trailer Hire Ltd to the unit;
-
sublet, rehire, or sell the unit or its associated equipment.

The Hirer must:
-
maintain the refrigeration trailer and its associated equipment in the condition in which it was delivered;
-
adhere to regular cleaning schedules as per environmental health regulations.

Return of the Trailer
-
Unless otherwise agreed, we will collect the trailer on or as close to the requested date and collection slot indicated in the Rental Agreement. The trailer must be empty, clean, and ready for collection according to these terms.
-
You or your authorized representative must be present to inspect and agree on the trailer's condition during delivery and collection. You remain responsible for all costs related to the trailer until it has been returned and accepted by us.
-
An allowance of 30 minutes is provided for collection once on site. If collection exceeds this time, additional fees of £45 per half hour or part thereof will apply until we can collect the trailer per these terms.

The trailer must be returned in a reasonably clean condition internally. All contents and packaging must be removed before our arrival, and the trailer should be cleaned as necessary. Any trailers returned in an unsatisfactory state will incur a minimum cleaning charge of £60. Cool Running Trailer Hire Ltd drivers will not remove any goods left in the trailer at the time of collection nor unblock access to the trailer.

Please note that no refund or discount will be provided if the trailer is returned early.

If our written permission is granted for the trailer to be towed by you or your appointed agents, you must:
-
obtain and ensure all necessary documentation and valid licenses to legally tow the trailer;
-
ensure that the towing vehicle is suitable for the trailer being hired;
-
determine whether a tachograph is required and comply with all related legislation;
-
ensure the trailer is secured to the towing vehicle or locked using the provided security devices;
-
arrange adequate breakdown cover, including repatriation of the trailer if necessary;
-
not take or allow the trailer to be taken outside mainland England, Scotland, or Wales without our prior written consent, and only under terms we deem appropriate if permission is granted.

Any expenses incurred by us in repossessing the trailer or recovering possession due to your default will be reimbursed by you upon request.

The trailer remains the property of A & L EVENTS LTD at all times, and you shall have no rights to it other than as Hirer.

You shall not permit any actions that could prejudice our rights concerning the trailer.
-
We provide no warranties, express or implied, regarding the accuracy of information on our website, and any material downloaded from our site is at your own risk. We assume no liability for any loss or damage, direct or indirect, arising from your use of that information or material.

Nothing in these terms limits our liability for:
-
death or personal injury caused by our negligence;
-
liability for defective products under the Consumer Protection Act 1987;
-
fraudulent misrepresentation.

We are not liable for any defects arising from normal wear and tear, intentional damage, negligence, abnormal working conditions, failure to follow our or manufacturer’s instructions, misuse, or unauthorized alterations or repairs to the trailer.

We shall not be liable for any damages, including loss of profits, prize funds, entry fees, lost savings, or any indirect, special, incidental, or consequential damages arising from the hire services, even if we have been advised of their possibility.

Nothing in these terms affects your statutory rights as a consumer. If you have questions about your statutory rights, seek independent legal advice. For any complaints regarding the hire services, please notify us in writing at the address or email provided above.

You agree to be fully responsible for all claims, liabilities, damages, losses, costs, and expenses, including legal fees, suffered or incurred by us due to any breach or default on your part regarding this hire contract.

Data Protection

We will take reasonable care to comply with our obligations under the Data Protection Act 1998 to keep your order and payment details secure. However, unless we are negligent, we will not be liable for any unauthorized access to the information you provide.

We will only use the information you provide to fulfil your order unless you agree otherwise.

We reserve the right to assign or delegate any of our rights or obligations under these terms upon notifying you.

Any failure by us to exercise any of our rights under these Terms and Conditions or any delay in enforcing compliance shall not operate as a waiver of that or any other right; nor shall any act, course of conduct, or negotiation on our part preclude us from exercising any such right or constitute a suspension or variation of any such rights.

Severability

If any clause of these Terms and Conditions is found to be invalid or unenforceable, the remaining clauses shall not be affected, and every other provision shall remain in effect.

Third Party Rights

None of the provisions in these Terms and Conditions are intended for the benefit of, or enforceable by, third parties (other than permitted assignees of Cool Running Trailer Hire, who may enforce these provisions as if they were original parties). The operation of the Contracts (Rights of Third Parties) Act 1999 is excluded.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with English Law, and the English Courts shall have exclusive jurisdiction for any disputes arising in connection with these Terms and Conditions. You and Cool Running Trailer Hire Ltd agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
